The law that applies

Transfers of property are governed by the Transfer of Property Act, 1882, and documents must be registered under the Registration Act, 1908 with stamp duty paid as applicable in Telangana. Suits for possession, declaration and injunction fall under the Specific Relief Act, 1963 and the Code of Civil Procedure, 1908, within the time limits of the Limitation Act, 1963.

Complaints about registered real estate projects are made to Telangana RERA under the Real Estate (Regulation and Development) Act, 2016, which provides for interest on delayed possession or refund with interest (section 18).

Pahani

Mutation
Changing the owner's name in revenue or municipal records after a transfer. It does not by itself create ownership.
EC
Encumbrance certificate: the record of registered transactions on a property for a chosen period.

A 'sale' through a general power of attorney and agreement. It does not transfer ownership; only a registered sale deed does.

Questions people ask

Someone is claiming my land using forged documents. What can I do?

Collect your title documents, tax receipts and evidence of possession. You can file a civil suit for a declaration of title, cancellation of the forged document (section 31 of the Specific Relief Act) and an injunction, and separately lodge a criminal complaint for forgery and cheating. Acting quickly helps preserve your position.

My tenant is not vacating. What is the legal process?

Send a notice terminating the tenancy as required by the agreement and the law. If the tenant still does not leave, file an eviction case before the Rent Controller where the rent control law applies, or a civil suit otherwise. Do not use force, change locks or cut water or power, as that can expose you to legal action.

What is an encumbrance certificate?

It is a record of registered transactions affecting a property, such as sales, mortgages and gifts, over a chosen period, issued by the Telangana Registration and Stamps Department and available online. It shows registered charges, but not unregistered claims or pending cases, so it is one part of title verification, not the whole of it.

Does a rental agreement have to be registered?

A lease from year to year, or for more than one year, must be registered under section 17 of the Registration Act. This is why many residential agreements are made for 11 months. An unregistered lease that needed registration cannot be relied on to prove its terms.

What does title verification involve?

It usually means examining the chain of ownership documents over a long period, often 30 years or more, checking encumbrance certificates, revenue and municipal records and approvals, and searching for pending litigation. The result is a written legal opinion on whether the title is clear.

My builder has delayed possession. What are my options?

For a RERA-registered project you can complain to Telangana RERA and seek interest for the delay or a refund with interest. The Supreme Court has held that homebuyers may alternatively approach the Consumer Commission (Imperia Structures v. Anil Patni, 2020). The better forum depends on your facts.

Is an agreement of sale enough to make me the owner?

No. Ownership of immovable property passes only through a registered sale deed. The Supreme Court has held that sales through a general power of attorney and agreement do not transfer title (Suraj Lamp & Industries v. State of Haryana, 2011).

Someone is encroaching on my land. What should I do first?

Collect your title documents and evidence of possession, and take advice quickly. A civil court can grant a temporary injunction to preserve the position while the case is decided, and delay can weaken your case.

Do daughters have a share in ancestral property?
